La gran mentira

Igual que no había armas de destrucción masiva en Irak, y aún así se inventaron informes y fotos que enseñaron en la sede de la ONU, en Iran no hay nada parecido a un programa nuclear militar secreto y con ánimos de matar a americanos.
Simplemente no existe. Igual que no había armas en Irak.
En Irak mintieron los inspectores y se manipuló la información.
En Iran se está haciendo lo mismo con organismos como la AIEA. Las mentiras se publican, pero la prensa calla la verdad.




'Sketchy IAEA report sets stage for war'
According to a 2009 Wikileaks cable, IAEA Director General Yukiya Amano asserted that "he was solidly in the US court on every key strategic decision, from high-level personnel appointments to the handling of Iran's alleged nuclear weapons program."

A former International Atomic Energy Agency (IAEA) director has spoken out against the agency's recent report on Iran's nuclear program, saying he does not want to see another war waged based on “recycled, discredited data.”

“In the 24-page document, intended for a restricted distribution but widely available on the Internet, all but three of the items that were offered as proof of a possible nuclear-arms program are either undated or refer to events before 2004,” Robert Kelley wrote in an article titled “Nuclear Arms Charge against Iran Is No Slam Dunk” on the Bloomberg website on Wednesday.

Of the remaining three, he added, two are attributed only to two member states, “so the sourcing is impossible to evaluate.”

Kelley said the remaining allegation was in fact a revival of a two-page document, “purporting to come from Iran,” which the IAEA received in 2009.

“Mohamed ElBaradei, who was then the agency's director general, rejected the information because there was no chain of custody for the paper, no clear source, document markings, date of issue or anything else that could establish its authenticity. What's more, the document contained style errors, suggesting the author was not a native Farsi speaker. It appeared to have been typed using Arabic, rather than a Farsi, word-processing program.”

The IAEA released its latest report on Tehran's nuclear program on November 8, claiming that Iran has been engaged in activities related to developing nuclear weapons before 2003, which “may still be ongoing.”

Iran dismissed the report as "unbalanced, unprofessional and prepared with political motivation and under political pressure mostly by the United States.”

Having already lobbied for the imposition of four rounds of UN Security Council sanctions against Iran, the US and its allies have since used the recent IAEA report to slap even stricter unilateral sanctions on the Islamic Republic.

On New Year's Eve, US President Barack Obama signed into law fresh economic sanctions against Iran's Central Bank in an apparent bid to punish foreign companies and banks that do business with the Iranian financial institution.

The European Union followed suit with its foreign policy Chief Catherine Ashton threatening Tehran with continuing sanctions. “I expect Iran will realize that we will continue with sanctions. EU members are discussing further sanctions right now,” she said.

The EU foreign ministers are expected to hold a meeting later this month on January 23 to discuss proposed embargo on Iran's oil exports.

The IAEA report has more alarmingly led to calls from various US and Israeli corners for a military strike against Iran.

On December 20, US Defense Secretary Leon Panetta claimed that Iran was one year away from building an atomic weapon, threatening that Washington will take every step “necessary” to stop Tehran's nuclear program.

Less than a week later, Chairman of the US Joint Chiefs of Staff General Martin Dempsey said the US military is ready to launch a military strike against Iran, if occasion necessitates.

With the upcoming US presidential election, the Republican candidates have similarly heightened the anti-Iran rhetoric, in an apparent bid to win Zionist votes.

Meanwhile, Israeli officials have also recently stepped up their war rhetoric against Iran. On November 21, Israeli Defense Minister Ehud Barak warned the "time has come" to deal with Iran. Israeli President Shimon Peres also threatened on November 6 that an attack against Iran is becoming "more and more likely."

The former IAEA director said he is “speaking up” about the flawed IAEA report, “because, as a member of the IAEA's Iraq Action Team in 2003, I learned firsthand how withholding the facts can lead to bloodshed.”

“Having known the details then, though I was not allowed to speak, I feel a certain shared responsibility for the war that killed more than 4,000 Americans and more than 100,000 Iraqis. A private citizen today, I hope to help ensure the facts are clear before the US takes further steps that could lead, intentionally or otherwise, to a new conflagration, this time in Iran,” he said.

KUALA LUMPUR, 19 November 2011 - The Kuala Lumpur War Crimes Tribunal ('Tribunal') commenced hearing war crimes charge of Crimes against Peace against George W Bush (former U.S. President) and Anthony L Blair (former British Prime Minister) in Kuala Lumpur, Malaysia.For the first time, a war crime charge has been heard against these two former heads of state in compliance with due legal process, wherein complaints from war victims had been received, duly investigated and formal charges instituted by the Kuala Lumpur War Crimes Commission (Commission). 

The Tribunal hearing was marked with the recusing of two judges and with the better part of the day spent on dealing with preliminary objections from the Defence team.

The Tribunal inquired in detail on the service of the charges (charges served on accused) against the two accused. The Prosecution referred to the Affidavit of Service filed and affirmed by the then registrar of the Tribunal, that the charges were served on 19 September 2011 to known addresses of the both accused and in addition, also served on the US Embassy and the UK High Commission in Kuala Lumpur. The service of the charges was in accordance with the rules of the Charter of the Kuala Lumpur War Crimes Commission ('Charter').

Mr Jason Kay, appointed as Amicus Curiae (‘Defence’) under Article 15 of the Charter raised two preliminary objections:
  1. on the jurisdiction of the tribunal to hear the case
  2. that Judge Niloufer Bhagwat withdraw from hearing the case on the grounds of potential bias.
On the issue of bias, the Defence submitted that judge Niloufer Bhagwat was involved as a judge in the International Criminal Tribunal For Afghanistan at Tokyo where George W Bush was found guilty for crimes in Afghanistan. And she had appeared as a prosecutor in the World Tribunal on Iraq against the same accused in Istanbul.

The Prosecution responded that the Iraq tribunal was a NGO session and not a court and the Tokyo tribunal and the Iraq tribunal were held in the absence of Bush. And the most important fact is that each case is decided on a case-by-case basis based on facts and law. In addition, the Iraq war and its atrocities, has caused everyone to have their own views. The Tribunal adjourned the sitting to deliberate on the matter.

Judge Niloufer Bhagwat made a statement that she had at all times fully disclosed to the Commission about her role in the previous tribunals. She highlighted that at the Nuremburg trials where the judges were all from the Allied powers, no issue of bias was raised. Although she had no vested interest in the matter of the present hearing, she would voluntarily recuse herself in the interest that ‘justice must be seen to be done’ (withdraw from the Tribunal panel for this hearing) so as not to cast even a shadow of partiality on the proceedings.

On the issue of jurisdiction, the Defence submitted that the Tribunal has no jurisdiction, as it has not been sanctioned by the United Nations. Nor is it under the Rome Statute as Iraq and Afghanistan are not signatories of the Rome Statute. Extensive submission was made in support of these points.

The Prosecution submitted that the tribunal is a Tribunal of conscience. The Prosecution submitted that no action has been taken despite numerous complaints of war crimes against the two accused by the International Criminal Court (ICC). The United Nations also failed to take any action to recommend criminal trials. It must be noted that the United States and the United Kingdom have veto powers in the UN Security Council.

The UN Charter starts with ‘We the peoples…’ The KL Charter is based on the peoples’ right. Today, People are making power accountable. In addition, this Tribunal is not usurping the authority of any organisation such as the UN. As a people, we have the right as humanity to act against war crimes. War crimes are universal in that there is no geographical limitation. God given conscience cannot be silenced. There are also views that this Tribunal has no purpose. The World Court can take into account judicial decisions of other judicial bodies. The Tribunal is made out of eminent people, which can set precedents in the legal authority of international law against war crimes.

After deliberation, the sittings resumed with the Tribunal president informing parties that Judge Zakaria Yatim had been taken ill and would not be able to continue serving on the panel. The quorum of five judges is permitted under the Charter of the Commission.

The Tribunal also unanimously overruled the preliminary objection and ruled that that it has the jurisdiction on the following grounds that:
  • The Tribunal is constituted under the Charter of the Commission, which is a legally constituted body.
  • By virtue of Article 7 (1) of the Charter the Tribunal has the jurisdiction to hear the charges before the Tribunal.
  • The Tribunal is a tribunal of conscience guided by the principal of natural justice.
  • The Commission’s Charter is inspired by the Rome Statute
  • Guided by previous tribunals of conscience such as the Russell Bertrand Tribunal for the Vietnam War and the Tokyo Tribunal for Afghanistan.
  • The Tribunal is complementary to the UN, which has thus far not acted on the complaints of war crimes against these 2 accused.
The prosecution made an application to the Tribunal to only hear the first charge, Crimes Against Peace, which the Tribunal permitted.

The Prosecution opened their case by outlining why this charge of Crimes Against Peace have been brought against the two accused:
  • To signal that no country, however powerful can arrogate to itself the right to commit the Crime against Peace, in this case attack another country in violation of international law.
  • To signal that there is culpability for such crimes by individuals, including heads of states, who authorise or acquiesce in the commission of such a crime.
  • To hold liable heads of states and not just punish petty minions.
  • To preserve the integrity of international law as it evolves and is now evolving. This can be done by consigning to the dustbin of history, the crude and naked arrogance and cruelty of power as demonstrated by the acts of these two accused - leaders supposedly of the free and civilised world.
  • These 2 accused had deceived their own country and the international community in furtherance of their evil and criminal design and objectives.
 The Prosecution commenced their case through the tendering of public documents showing that the attack on Iraq was planned prior to 9/11 and was an ongoing plan until the actual attack on Iraq in 2003. The UN Resolution 1441, which was relied upon by the US and UK to launch the attack was also scrutinised to show that there was no authority to use force under the said resolution. There was a need for the UN to actually authorise the use of force by way of a second resolution. This was evidenced by the history of negotiation of UN Resolution 1441 wherein there was clear indication that the resolution did not authorise the use of force.

The hearing proceeded till the end of the evening and will continue on Sunday 20 November 2011.

The trial is being held in an open court from November 19-22, 2011 at the premises of the Kuala Lumpur Foundation to Criminalise War (KLFCW) at 88, Jalan Perdana, Kuala Lumpur, Malaysia.

The Charge

Crimes Against Peace filed against George W Bush (former President of the U.S.) and Anthony L "Tony" Blair (former Prime Minister of the United Kingdom) wherein they are charged as follows:

The Accused persons had committed Crimes against Peace, in that the Accused persons planned, prepared and invaded the sovereign state of Iraq on 19 March 2003 in violation of the United Nations Charter and international law.

The Tribunal will adjudicate and evaluate the evidence presented on facts and law as in any court of law. The judges of the Tribunal must be satisfied that the charge is proven beyond reasonable doubt and deliver a reasoned judgement. The verdict and the names of the persons found guilty will be entered in the Commission’s Register of War Criminals and publicised worldwide.

El veto

El 4 de Octubre, China y Rusia vetaron una resolución de la ONU sobre Siria en la cual se le acusaba de extrema violencia contra las protestas pro-democráticas.

Una de las razones del veto, es que podría abrir otra vez una opción militar estilo Libia:



Aunque el gobierno sirio no sea de mi gusto, lo que está pasando en Libia justifica con creces que se pare cualquier tipo de movimiento en la ONU que pueda justificar que Siria pueda acabar como Libia o peor aún.

Se ha armado un revuelo tremendo contra China y Rusia por usar su derecho a veto en el consejo de seguridad, bajo el pretexto cínico de que están matando a civiles y un uso excesivo de la fuerza represora.
Como el tema de la represión y uso de la fuerza desmesurada no está en mi interés desarrollarlo en este post, solo puedo decir que lo que está ocurriendo en Libia bajo la cobertura de una resolución aprobada por el consejo de seguridad de la ONU (UNSC) es no sólo un uso desmesurado de la fuerza y ya no sólo contra militares, sino contra la población civil indefensa.
En Libia se están saltando todas las leyes y las normas que se supone que rigen y aplican a todos los estados, y que tan bien están definidas por la ONU.

Sobre el UNSC

The United Nations Security Council (UNSC) is one of the principal organs of the United Nations and is charged with the maintenance of international peace and security. Its powers, outlined in the United Nations Charter, include the establishment of peacekeeping operations, the establishment of international sanctions, and the authorization of military action. Its powers are exercised through United Nations Security Council resolutions.

El consejo de seguridad es uno de los principales órganos de las naciones unidas y está encargado del mantenimiento de la seguridad y paz internacional.
...incluye el establecimiento de operaciones de mantenimiento de la paz... sanciones internacionales...autorización de "acciones militares".

Pues yo creo que empezamos bien con esa definición. Resulta contradictorio que en su definición hablen  del mantenimiento de la paz y acciones militares. Es meter al zorro en el gallinero.

Si vis pacem, para bellum. 
 Si quieres la paz prepárate para la guerra. Dicho de otra forma, si eres fuerte militarmente te van a temer y probablemente no te ataquen.

Claro que los que mandan en el UNSC son 5, y por pura casualidad, son los primeros 5 ejércitos del mundo y fabricantes de armas y de sus municiones.

Sobre el derecho al veto

Francia, Inglaterra, China, Rusia (antes la URSS) y Estados unidos tienen derecho a veto.
Estos 5 países con su veto pueden tirar por la borda cualquier acción del UNSC aunque haya unanimidad.
El veto la invalida.
Este derecho exclusivo de esas 5 naciones ha sido miles de veces criticado por muchos países, órganos independientes e incluso dentro de la misma ONU. 
El derecho a veto normalmente ha sido usado por esos países para sus propios intereses.
Teniendo en cuenta que durante la guerra fría había dos bloques:
3 países de la OTAN ( USA, Francia e Inglaterra) y por otro lado la China comunista y la URSS, el UNSC ha sido prácticamente inútil para adoptar medidas justas y equitativas, porque si era bueno para unos , los otros se oponían.

Sobre las resoluciones del UNSC

Las resoluciones aprobadas desde la creación de las Naciones Unidas se pueden consultar aquí
Entre ellas hay una resolución, la 242, que nunca se ha aplicado( es una curiosidad entre tantas).
Hay muchas, muchisimas que no se ha aplicado, y que siguen en vigor.
Siguen en vigor porque resoluciones posteriores relativas al asunto, se "REAFIRMAN" en esa resolución adoptada, es decir, se basan en ella para seguir hablando del caso, ampliándolo si cabe e incidiendo en la actualidad.

Esas resoluciones han sido aprobadas y no han sido vetadas, por lo tanto son vigentes y aplicables. Es más: es exigible su aplicación.
Si reconocemos la ONU y su UNSC como organos internacionales legales y con, digamos, criterio y mandato internacionalmente reconocido por todos los miembros, lo lógico sería que las resoluciones se aplicaran SIEMPRE y en cualquier caso, dado que han sido aprobadas por los representantes de todos los países miembros.
PUES NO.
Las hay que se aplican, las hay que se aplican tarde, las hay que nunca se aplican, y las hay que se aplican inmediatamente, tan inmediatamente que parece que están hechas a medida y estaban coordinadas, preparadas.
Estas últimas son los casos más flagrantes y escandalosos, pues casi todas han acarreado "acciones militares".
Sólo como ejemplo mencionar la 1970 y 1973 que afectan a la invasión, bombardeo y derrocamiento del gobierno de un país soberano y miembro de las Naciones Unidas, Libia.

Se ve que la 1973 se basa en la 1970, como muchas otras:

Estas han sido de inmediata aplicación.


La redacción de estas resoluciones es un apartado que requiere explicación.
Cuando se plantea redactar una resolución, hay grupos de trabajo que se organizan, consultas, pulsos entre estados para saber hasta donde se puede "apretar", hasta donde se puede llegar para que se apruebe.
Por lo tanto, la redacción de esas resoluciones es un conglomerado de palábros que muchas veces pueden significar cualquier cosas, dado que la intención es tener un texto ambiguo, aunque consensuado, que permita a cualquiera hacer con el lo que quiera.


El cinismo relacionado con las resoluciones del UNSC

Cualquier persona se piensa que tanto las Naciones Unidas, como su UNSC son órganos independientes, legales, formales y velan por la paz y seguridad de todos los países del mundo, y por lo tanto no cabría queja ni duda de su integridad.
Pues bien eso no es así.
Nunca ha sido así, y me temo que nunca lo será.


Existe un doble rasero escandaloso con el tema de las resoluciones, su aplicación y su veto.


Estados Unidos ha ejercido su veto siempre que cualquier resolución a votar, con textos muy elaborados y rescritos mil veces, tuvieran algo que ver con Israel.

Explicar la causa palestina tampoco es ahora el momento, aunque mucho sepan de ella. Pues bien, cualquier resolución que tuviera algo que ver con los asentamientos, sería inmediatamente vetada por USA y aplaudida por Israel.
Demasiados ejemplos del veto de USA a cualquier resolución que afecte a Israel y la Palestina ocupada.
Y ese es un conflicto que lleva abierto casi ocho décadas. 
Sobre este caso, se han aprobado muchas resoluciones de la ONU, se han vetado muchas más, y nunca se ha aplicado ninguna.
El conflicto sigue y sigue, y cada vez con peor solución.


Para Israel, hay manga ancha siempre. Hagan lo que hagan cuentan con la bendición del veto americano.
En la guerra de 2006 contra el Líbano, hasta la Señora Rice tuvo las agallas de decir que no habría resolución hasta que Israel hubiese terminado su trabajo. Era el parto de un nuevo medio-oriente.

Para ver puro cinismo:











Ese cinismo, no es más que hay que tapar que en la ONU manda EEUU con la bendición y genuflexión europea.
La política exterior americana, viene avalada por la ONU. Y sino lo avala la ONU, se plantean una resolución. Y si no hay acuerdos previos para alcanzar unanimidad y evitar vetos, pues van por libre.
Lo que pasa que queda mejor hacer guerras y hacer lo que te interesa con el aval de muchos países, porque así son cómplices.

La prensa afína la OTAN, tilda el veto de China y Rusia de "infamia".
Un ejemplo muy claro del señor Bassets, jefazo en "El País", y mendigo de la OTAN.
LLama la atención que nunca ha criticado todo lo que se ha mencionado en este post: doble rasero, absolución de Israel de todo pecado, defensa a ultranza de los judíos y su lobby, el incumplimiento de las leyes que para palestinos, libios, sirios, irakies, afganos no aplican, pero sí para Israel.
Si vetar según este señor es infamia....



Doble e infame veto

La superpotencia derrotada de la Guerra Fría y la superpotencia ascendente del siglo XXI han trazado una raya en la arena. Hasta aquí hemos llegado. El momento es dramático. Moscú y Pequín sacan pecho justo cuando Washington y Bruselas demuestran mayores dificultades para gobernarse, gobernar el mundo y rescatar a las economías occidentales del pozo. Es una demostración de la debilidad de unos y de la pujanza de los otros, un momento del desplazamiento de poder en el mundo, del que las revueltas árabes son el último y más espectacular avatar. Detrás de las superpotencias clásicas también sacan pecho las aspirantes, los emergentes: Brasil, India y Suráfrica. A costa de los sirios, que sufren lo indecible bajo la bota de un régimen criminal: 2.700 ciudadanos fallecidos en los seis meses de revuelta, millares de heridos, detenidos y torturados, decenas de miles de refugiados en Turquía, Líbano y Jordania.
La discusión y el debate en el Consejo de Seguridad sobre Siria ha sido la segunda vuelta, con resultado adverso, de las resoluciones sobre Libia, que permitieron la intervención área de la OTAN y el derrocamiento de Gadafi. Rusos y chinos han rechazado una aguada resolución largamente negociada por los europeos contra el régimen de Bachar el Asad, en la que ni siquiera se hablaba de sanciones y todo se limitaba a advertencias, reproches y buenos deseos.
Los argumentos de los rusos, que como es habitual son los que han llevado la voz cantante, son terribles y devastadores para los revolucionarios árabes que quieren deshacerse de los autócratas: simetría entre régimen y oposición, a la que también se responsabiliza de la violencia; exclusión abierta de cualquier intervención internacional; rechazo ya no a cualquier régimen de sanciones sino a las meras presiones; y reconducción de la acción internacional a las arcangélicas recomendaciones de diálogo y de reformas.
No hay hipocresía alguna, al contrario. En todo caso, cinismo. Es una exhibición de fuerza y una advertencia. La responsabilidad de proteger, consagrada por Naciones Unidas en 2005, recibe un duro revés después de aquel éxito inesperado en el caso de Libia. Regresan al galope los principios de no injerencia y de respeto a la soberanía nacional. Moscú y Pekín se sienten más que insatisfechos por la aplicación de las resoluciones contra el régimen de Gadafi. Sostienen que no se ha protegido a la población civil de los ataques del coronel sino que todo se ha hecho para cambiar el régimen. Por la cuenta que les trae como países violadores de los derechos humanos y sin escrúpulos a la hora de acudir a la fuerza, cortan por lo sano la posibilidad de una expansión del principio de la responsabilidad de proteger. Es también un recordatorio a Washington respecto a su reiterado uso del derecho de veto para defender al gobierno de un país como Israel, vecino y enemigo nada menos que de Siria, protegido y aliado histórico de Moscú desde los tiempos gélidos del mundo bipolar.
Rusia y China han utilizado el derecho de veto para frenar a los occidentales en Siria. Es un hito en la evolución de las revueltas árabes: las dos superpotencias han sacado el lápiz para marcar el mapa. Lo hizo ya anteriormente Arabia Saudí con su intervención armada en Bahrein. Europa y Estados Unidos, en un instante excepcional de acierto geopolítico, lo consiguieron también con los bombardeos de la OTAN en Libia.
No es frecuente el uso del derecho de veto conjuntamente por parte de dos países en el Consejo de Seguridad. Esta rara pareja lo ha utilizado en tres ocasiones nada gloriosas, que marcan una línea de conducta en defensa de las dictaduras y un inquietante sendero para el siglo XXI. En 2007, Rusia y China rechazaron una resolución que pedía el respeto de los derechos humanos y la liberación de los presos políticos, entre ellos de Aung San Suu Kyi, en Birmania; en 2008 evitaron un régimen de sanciones y el embargo de armas contra el presidente de Zimbabue, Robert Mugabe; y ahora sortean cualquier apercibimiento a Siria por la represión desencadenada contra las protestas ciudadanas.
Brasil, Suráfrica e India no han querido dejar solos a chinos y rusos: situados junto a Estados Unidos y Europa, la votación hubiera arrojado doce votos a favor y dos en contra, con la abstención obligada de Líbano, suficiente para salvar a Assad pero con un alto precio simbólico para Rusia y China, que igual hubiera cambiado su voto. Los emergentes también esperan sacar su tajada geopolítica de los cambios y de la debilidad europea y estadounidense, y a la vez no enemistarse innecesariamente con los ganadores del envite. La infamia del veto doble ha llevado a Alemania, propensa a desmarcarse como si fuera un emergente más, a votar con Washington y los otros países europeos y dejar así un incongruente mensaje después de abstenerse en la resolución contra Gadafi. Europa es débil, pero al menos esta vez existe.
